Terms of use

Dear visitor, anyone (hereinafter referred to as "User") wishing to access the website www.escursionibarcacarloforte.it (hereinafter referred to as "Site") and its functions is aware of the necessary full acceptance of the terms of use described below (hereinafter referred to as "Terms"). Such acceptance constitutes a contract between the User and the owner of the Site. The owner of the Site reserves the right to change the Terms at any time without any prior notice. Access to any screen or function of the Site and its services is proof of the User's viewing and acceptance of the Terms. Any new access to the Site implies reading and accepting the Terms and the consequent new acceptance of the contract.

 

The Site may contain links and references to websites or applications not managed by the owner of the Site and are provided as a mere reference. If used, you exit the Site, and the Owner disclaims all responsibility: the Owner is in no way responsible for the content provided by third parties and cannot be held liable for direct and indirect damages arising from the use of the aforementioned links and references. It is prohibited to make connections or links to the contents of this Site without the prior written authorization of the Company.

 

The User is required to read the information on the processing of personal data made available on the dedicated page of the Site in accordance with EU Regulation 2016/679. This information refers exclusively to the procedures adopted by the Site owner.

 

The User agrees not to interfere with the operation of the Site and not to compromise its security. The User will strictly adhere to the legal purposes while browsing and using the Site.

 

The Terms describe the services offered by the Site owner.

 

The User is aware that the Terms are valid in the Italian version and any translations do not constitute evidence if they differ from the original text in Italian.

Definitions  

  • Site. The term "Site" refers to the website accessible via the link www.escursionibarcacarloforte.it (hereinafter "Site").  

  • Owner. The owner and proprietor of the Site is Gianluca Perdisci (hereinafter "Owner"), a member of the Società Cooperativa Golfo di Palmas, located at Via Garibaldi, 32 Sant'Antioco (SU) and registered with the Chamber of Commerce of Cagliari in Italy with VAT number IT02730570922.  

  • Activity. The "Owner" operates a guided activity of excursions, trips, fishing tourism, and boat tours in southern Sardinia, Italy (hereinafter "Activity").  

  • Reservation and Customer. "Reservation" refers to the explicit communication of someone's intention (hereinafter "Customer") to access the services offered by the Owner on a specific date at a specific rate for themselves or for others.  

  • Passengers. "Passenger" refers to anyone who accesses the onboard services offered by the Owner through the Activity.  

  • Captain. The "Captain" is responsible for the conduct and safety of a vessel provided by the Owner for the Activity.  

  • Rate. The Rate is the agreed sum paid by the Customer to the Owner for the enjoyment of the Activity.

 

Reservation 

  • At the time of the Reservation, the Holder collects and records the intention expressed by the Customer via email, phone, messaging system, website, or direct personal contact to access the services offered by the Activity.

  • The Holder accepts only reservations from individuals of legal age. 

  • The Holder commits to communicate the outcome of the Reservation to the Customer as soon as possible, confirming or denying the availability of the requested services. 

  • At the time of the Reservation, the Customer agrees to provide the Holder with truthful information and data regarding their identity, as well as that of any other individuals for whom the request is made, concerning any other needs described later in these Terms.

 

People on board 

  • The Owner reminds that in the services of the Activity: 

  • Children under the age of five are not allowed. 

  • Individuals under 18 years old must be accompanied by a parent or an adult who acts in a parental role. 

  • The supervision of minors is the responsibility of the parent or adult acting in their place. These adults are responsible for the behavior and safety of the accompanied minors on board. 

  • For safety reasons, only individuals with independent mobility are allowed on board. 

  • Individuals with disabilities are required to communicate the nature of their condition to assess specific needs that facilitate their experience and ensure safety on board. 

  • Individuals with serious medical conditions are required to communicate the nature of their condition to assess specific needs that facilitate their experience and ensure safety on board. 

  • Individuals who cannot swim are required to wear a life jacket for the entire duration of the excursion. The crew disclaims any responsibility in case of refusal to follow this practice. 

  • Individuals with forms of thalassophobia, aquaphobia, hydrophobia, cimophobia, and scopophobia are not allowed on board. 

  • Pregnant women are advised to carefully assess whether their condition is compatible with life on board and navigation.

  • All individuals who suffer from seasickness are advised to assess whether and which remedies are necessary to bring on board to overcome or mitigate any potential state of discomfort that may arise while sailing. The onboard staff does not provide guests with remedies for seasickness.

 

Boarding Access  

  • Access to boarding is conditioned on a Reservation made with the Holder or through the authorized websites and affiliated operators.  

  • Access to boarding is conditioned on the payment of a Fee indicated by the Website, by the affiliated websites, by the affiliated operators, or agreed upon with the Holder.  

  • Access to boarding is conditioned on compliance with the boarding times indicated on the Website, by the affiliated websites, by the affiliated operators, or agreed upon with the Holder.  

  • Passengers must present themselves at the boarding location at least fifteen minutes before the scheduled departure.  

  • The boarding location is agreed upon by the Holder with the Passengers at the time of the Reservation. In general, the expected boarding locations are indicated on the Website.  

  • The boarding and disembarking operations are managed by the Captain and the onboard staff. Passengers must adhere to their instructions.

 

Equipment Provided  

  • All safety equipment is available on board, including life rings and life jackets.  

  • Passengers are provided with snorkeling equipment consisting of a mask and snorkel free of charge on board.  

  • Snorkeling equipment in the exact size for each guest may not be available.  

  • The onboard staff sanitizes the equipment before each excursion.  

  • The guest receiving the equipment agrees to use it with the utmost care and to return it in the condition it was received.  

  • In case of loss or damage to the snorkeling and safety equipment, the customer agrees to reimburse its value as new.  

 

Services Included in the Rate  

  • fuel

  • skipper and crew (if applicable)  

  • rinse shower  

  • toilet with WC  

  • snorkeling equipment  

  • life jackets  

  • shade awning  

Food and drinks on board  

  • On board, the Commander keeps, manages, and makes food and drinks available for the Passengers.  

  • The food and drinks provided by the Commander for the Passengers are included in the Fare.  

  • "Onboard lunch" refers to a fixed menu typically consisting of an appetizer, a first course, fruit, and beverages.  

  • Among the beverages, there may be alcoholic options, such as beer or wine.  

  • The Commander ensures to have a sufficient supply of drinking water to quench the thirst of all people on board for ten hours.  

  • The Commander does not serve alcohol to minors under 18 years of age.  

  • The menu may vary at the discretion of the Commander.  

  • "Apéritif" refers to a light meal consisting of food and drinks.  

  • It is the Customer's right to know from the Owner which food and drinks will be provided on board, what ingredients are used, and their origin.  

  • The Customer is required to communicate any food intolerances of the Passengers for whom they are booking at the time of Reservation.  

  • The Commander does not plan to provide vegan meals.  

  • Each Passenger is allowed to bring a supply of water or other non-alcoholic beverages not exceeding six liters.  

  • Passengers are not allowed to cook on board.  

  • Passengers are allowed to bring ready-to-eat food only for personal use.

 

Animals  

  • Any request for animal access on board must be communicated at the time of booking to the Owner, who has the sole discretion to evaluate its acceptance.  

  • Any access of animals on board must be authorized by the Captain, who has the sole discretion to assess its appropriateness.  

  • In any case, animals displaying aggressive behavior towards people or other animals are not permitted.  

  • Owners must ensure they have equipment to control, restrain, and contain their animals on board, such as leashes and muzzles.  

  • Owners agree that animals will not disturb people on board, obstruct navigation maneuvers, or jeopardize safety.  

  • Owners commit to ensuring that animals do not soil or compromise hygiene on board.  

  • The Activity does not include the provision of food and beverages for animals.  

  • The Activity does not include the provision of rescue equipment for animals.  

  • The Activity does not include the provision of insurance coverage for animals.

Items not allowed on board  

  • Items with a volume greater than 60 x 40 x 30 cm are not allowed on board.  

  • Items and containers weighing more than 10 kg each are not allowed on board.  

  • The total weight that each passenger can bring on board must not exceed 20 kg.  

  • Weapons or objects intended to harm of any kind are not allowed on board, including personal use knives.  

  • Explosives of any kind are not allowed on board.  

  • Fishing equipment of any kind, including underwater gear, is not allowed on board.  

  • Fragile items whose breakage could jeopardize the safety of people on board are not allowed.  

  • It is not permitted to bring any type of narcotic substances on board.  

  • It is not permitted to bring alcoholic beverages or spirits on board.  

  • It is not permitted to bring flammable materials on board.

 

Behavior

  • The Commander is the overall responsible for safety. Every instruction regarding this must be followed by the people on board, both in port and while navigating.

  • Passengers commit to not jeopardize the safety of people, animals, and property present on board.

  • Passengers commit to not interfere with the safety of other nearby vessels.

  • Passengers commit to not exhibit disturbing, aggressive, or hostile behavior towards people, animals, and property present on board.

  • Passengers commit to not exhibit disturbing, aggressive, or hostile behavior towards people on other nearby vessels.

  • Passengers commit to not produce disturbing noises through electronic devices, including smartphones and computers.

  • Audio, video recordings, and photos may not be taken without the consent of the people being recorded.

  • Smoking is not allowed on board.

  • The use of soaps, shampoos, and shower gels for showers or rinses is not allowed on board.

  • The use of open flames is not allowed on board.

  • Sales practices or service provision among Passengers are not permitted on board.

  • Ball games, wheel games, rope games, throwing games, and kites are not allowed on board.

  • Independent fishing activities, other than those conducted by the Commander and the crew, are not permitted.

 

Clothing  

  • It is recommended to wear comfortable and light clothing, or in any case suitable for onboard activities and the day's climate.  

  • Heels or footwear that could damage the deck material are not allowed onboard. We recommend wearing shoes with non-slip rubber soles or going barefoot.  

  • It is advisable to wear a cap, sunglasses, and clothing that helps reduce sun exposure.  

  • For swimming activities, appropriate clothing is required.  

 

Excursion Route  

  • The excursion routes are indicated and described on the Website.  

  • It is at the Customer's discretion to inform the Owner at the time of Booking which route they intend to choose from those indicated on the Website.  

  • Due to seat availability, weather conditions, public authority regulations, or general organisation, one or more routes may not be available at the time of Booking.  

  • Due to adverse weather conditions, navigation safety, or public authority regulations, the Captain of the vessel may, at their sole discretion, make changes to the agreed route with the Customers.  

  • For tourism opportunities and in agreement with the Passengers, the Captain may make route changes.

 

Cancellations  

  • The excursion activity may be canceled or interrupted for the following reasons:  

  • adverse weather conditions.  

  • critical health conditions of the Captain or crew.  

  • critical health conditions of one or more guests on board.  

  • unforeseen critical conditions of the boat that compromise its functionality or safety.  

  • provisions of public authorities.  

  • behavior of one or more Passengers that may jeopardize the tranquility of navigation or its safety.  

 

Prices  

  • The prices indicated on the Site are in euros.  

  • The prices indicated on the Site include VAT.  

  • The prices indicated on the Site may differ from those indicated by partner sites, operators, and services.  

  • The prices indicated on the Site may differ from those agreed upon with the Owner.

 

Refunds  

  • A refund of the fee paid by the Customer is provided in the following cases:  

  • The Customer communicates the cancellation with three days' notice before the booked departure date.  

  • The excursion is canceled by the Captain with advance notice due to adverse weather conditions.  

  • The excursion is canceled by the Captain at departure due to adverse weather conditions.  

  • The excursion is canceled by the Captain due to adverse weather conditions when the excursion has started less than an hour ago.  

  • The excursion is canceled by the Captain due to unavailability of the boat.  

  • The excursion is canceled due to unavailability of the Captain or crew.  

  • The excursion is canceled by the Captain due to orders from public authorities.  

 

Jurisdiction  

For any disputes, the jurisdiction of Cagliari is to be considered competent.
